Summary

The NATO Support and Procurement Agency (NSPA) has published a Notification of Planned Sole Source Award (No. 26LDM015). NSPA intends to award a contract without competition to Lockheed Martin Global, Inc. (CAGE code 6WZB6). The procurement covers the Small Target Capability upgrade of the AN/TPS-77 radars deployed in Romania, comprising the supply, assembly, testing and integration of the capability into these radars. NSPA justifies the sole source award on the grounds that Lockheed Martin Global is the original equipment manufacturer (OEM) of the AN/TPS-77 radars. Delivery and integration of the capability require access to Lockheed Martin's Technical Data Package (TDP) and to the source code of the operational software, which are not available to other suppliers. Lockheed Martin Global is the sole holder of the TDP. Any company that considers itself capable of meeting the requirement must submit evidence of its capability (e.g. proof of past performance) to the e-mail addresses specified in the notification no later than 10 calendar days after publication. NSPA will evaluate the evidence and provide a written response no later than 15 calendar days thereafter. The deadline stated in the notification is 1 December 2026. No monetary value is stated. The notification also sets out a detailed procedure for lodging a complaint regarding the sole source award (OI 4200-08) and for appealing to the ARDB (OI 4200-09). These NSPA Operating Instruction documents contain additional conditions that have not been taken into account in this summary.
